These Terms of Use govern your access to and use of the SoundCheck Trivia website, web app, mobile app, trivia platform, host tools, venue tools, and related services. The Service is operated by Drunken Pirate Development LLC, DBA SoundCheck Trivia ("SoundCheck Trivia," "we," "us," or "our").

By creating an account, accessing the Service, joining a trivia game, managing a venue, hosting an event, purchasing a subscription, or otherwise using the Service, you agree to these Terms.

1. Eligibility

You must be able to form a legally binding agreement to use the Service. If you use the Service on behalf of a business, venue, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate information and keep your account information reasonably current.

We may suspend or terminate accounts that contain false information, violate these Terms, create security risks, abuse the Service, or interfere with platform operations.

3. User Roles

The Service may support different account roles, including players, hosts, venues, and administrators.

Players may join trivia games, participate in teams, appear in standings, and manage their own account preferences.

Hosts may manage trivia games, teams, scoring, and related event operations.

Venues may manage venue profiles, subscriptions, events, league-related participation, and permitted platform communications.

Administrative users may manage platform operations, support, moderation, billing, and compliance.

4. Trivia Games, Scores, and Leaderboards

The Service may display scores, standings, league results, team names, player names, and related gameplay information.

We may correct, remove, modify, or adjust scores, standings, game records, or leaderboard information when reasonably necessary to address errors, abuse, technical issues, duplicate entries, cheating, rule violations, or host/admin corrections.

We do not guarantee that any score, ranking, prize eligibility, leaderboard placement, or game result will be error-free.

4A. Reviews and "Rate Tonight"

Anyone may leave a review of a venue or a host, with or without an account, including through the "Rate your host & venue" link shown after a game. A review is a rating of 1 to 5 stars, with optional text of up to 500 characters and an optional first name. A review left without a first name is shown as written by "Guest."

To keep reviews fair and free of spam:

Reviews are protected by Cloudflare Turnstile, which checks that a real person is submitting the review.
Only one review is kept per device for each venue and each host, and one per signed-in account for each venue and each host. A new review from the same device or account replaces the earlier one.
Reviews left through a game's "Rate your host & venue" link are linked to that game, so the venue and host can see the venue and date of the game the review is about.

Reviews are public. Venues and hosts may post a public reply to a review about them. Your review must reflect your own honest experience and must follow Section 7 (Acceptable Use) and Section 8 (User Content). We may remove or restrict reviews that violate these Terms.

5. Subscriptions and Paid Services

Some features may require payment or an active subscription.

Subscription terms, renewal timing, cancellation rules, refund rules, and payment terms are described in the Payment & Billing Policy, which is incorporated into these Terms.

5A. Host Referrals and Payouts

Registered hosts may earn referral rewards for bringing new venues to SoundCheck Trivia under the referral offers we make available from time to time. Each host receives a personal referral code and link for each active offer. Each offer states its host reward, what the referred venue must do for the reward to be earned, and any discount the venue receives.

Only new venue accounts qualify. A venue does not qualify if a venue with the same business license number and issuer, or with the same Owner account, had a paid subscription in the past 3 years.
Only one offer applies to a venue. Referral codes never combine with another promo code or referral code.
A referral keeps the reward of the offer it was made under, even if that offer is later changed or ended. We may create, change or end offers at any time; a change does not affect referrals already made.
A reward is paid only after its requirement is met, then after a 6-week waiting period, on the 1st day of the following month.
Rewards are paid to the host's bank account through Stripe Connect as standard payouts. To be paid, the host must connect a Stripe account and complete Stripe's identity verification. Stripe's own terms apply to the host's Stripe account.
Stripe sends the host a Form 1099 if the host's earnings for the year require one. Hosts are responsible for their own taxes on referral rewards.
A reward already paid is not taken back because of a later chargeback on the venue's payment.

6. Cancellation

Canceling a subscription stops future renewals. Unless otherwise stated, cancellation does not result in a refund or prorated credit for the current billing period. Access to paid features will generally continue until the end of the current prepaid term unless the account is terminated for violation of these Terms.

7. Acceptable Use

You agree not to:

Use the Service for unlawful, harmful, fraudulent, abusive, or deceptive purposes
Attempt to gain unauthorized access to any system, account, or data
Interfere with or disrupt the Service
Upload or submit malicious code
Scrape, copy, harvest, or extract data without permission
Impersonate another person or entity
Misrepresent your relationship with a host, venue, business, or organization
Use the Service to harass, threaten, defame, or abuse others
Submit content that infringes intellectual property or privacy rights
Use the Service in a way that damages our reputation, systems, users, hosts, or venues

8. User Content

Users may submit information such as names, team names, venue information, event details, messages, images, or other content.

You are responsible for content you submit. You grant us the right to use, display, store, process, reproduce, modify, and distribute submitted content as needed to operate, promote, secure, and improve the Service.

We may remove or restrict content that violates these Terms or creates legal, operational, or reputational risk.

9. Venue Communications

Venues may be allowed to send platform-managed announcements to former players or participants, subject to user email preferences and applicable law.

Venues do not receive direct access to player email addresses for this purpose unless separately authorized through a permitted feature.

10. Intellectual Property

The Service, including software, design, branding, logos, text, graphics, workflows, and platform features, is owned by SoundCheck Trivia or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, reverse engineer, sell, lease, or exploit the Service except as expressly allowed by us.

10A. Game Content

Game Content. Questions, answers, songs, fun facts and other game content you see during a game or in your account (for example, in your game history) are the proprietary and confidential property of Drunken Pirate Development LLC, DBA SoundCheck Trivia. You may view them for your own personal, non-commercial use only. You may not copy, screenshot, post, share, publish, sell or otherwise distribute them, use them in any other game, quiz, app or product, or collect them by automated means or use them to train any software or artificial intelligence model. If you do, we may suspend or close your account and take legal action as allowed by law. See the Game Content Legal Notice at soundchecktrivia.com/legal/game-content.

11. Service Availability

The Service is provided on an "as is" and "as available" basis.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.

We may perform maintenance, updates, repairs, or changes that temporarily affect availability.

No uptime guarantee, service-level agreement, service credit, or availability commitment applies unless we separately agree to one in writing.

12. Third-Party Services

The Service may rely on third-party providers for hosting, payments, email, analytics, authentication, communications, or other functionality.

We are not responsible for third-party service interruptions, errors, fees, policies, or actions.

12A. Third-Party Data Attributions

US postal code data used in the Service is provided by GeoNames (https://www.geonames.org), licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0, https://creativecommons.org/licenses/by/4.0/).

13. Suspension and Termination

We may suspend, restrict, or terminate access to the Service if we believe a user has violated these Terms, created risk, failed to pay, misused the Service, violated law, or interfered with platform operations.

Upon termination, access to the Service may end immediately. Certain records may be retained as described in the Privacy Policy.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or reliability.

15. Limitation of Liability

To the fullest extent permitted by law, SoundCheck Trivia will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, or service downtime.

To the fullest extent permitted by law, our total liability for any claim related to the Service will not exceed the amount paid by you to us for the Service during the twelve months before the event giving rise to the claim, or one hundred dollars, whichever is greater.

16. Indemnification

You agree to defend, indemnify, and hold harmless SoundCheck Trivia, its owners, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your content, your violation of these Terms, your violation of law, or your violation of another person's rights.

17. Changes to the Service

We may modify, update, suspend, discontinue, or remove features at any time. We are not required to continue offering any specific feature, layout, workflow, pricing plan, or integration.

18. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted with a revised effective date. Continued use of the Service after changes become effective means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
